The Challenges of the Responsibility to Protect on the African Continent. The Case of Darfur

Abstract

The purpose of the study is to explore and analyse the challenges of the R2P on the African Continent with respect to the relationship between R2P and the AU Constitutive Act which forms the central research questions. The congruence and contradictions between R2P and AU Act as basis of the research problem are invested. The theoretical framework informs the study of seemingly insincere accepts of the concepts of “sovereignty as responsibility” replacing “sovereignty as absolute political control” by AU member states. This study adopted qualitative research design methodology and data analysis. The key findings of this study were inter alia, the similarities of the thresholds for intervention for R2P and Article 4 (h) of AU Act but with sharp contrast on the implementation matrix question of intervention against humanity. The major recommendations made as part of conflicts prevention and resolution focus in the areas of economic, social, political and security sectors.
